Situation:
When a laptop computer lost a series of emails shortly before the start of legal action, the disappearance raised the suspicion of the opposing counsel. IT Direct was called in to avoid the possibility of a negative inference – the assumption that the lost evidence contained damaging information. If a jury were presented with a negative inference, it would be a difficult obstacle to overcome.
Response:
IT Direct evaluated the laptop to determine the cause of the deleted emails and offered conclusive proof that they were inadvertently lost. When the opposing counsel learned the cause of the deleted emails, they dropped the matter before pursuing it in court. This saved the client from a potentially damaging situation.
